3. PRODUCTS & SERVICES

3.1 Natural Product Variations

Our spices are natural and chemically free; therefore, variations in color, aroma, texture, or batch differences are natural characteristics and are not considered defects.

3.2 Pricing & Errors

We reserve the right to modify product prices at any time without notice. If a product is listed at an incorrect price due to technical or human error, we reserve the right to cancel the order and refund you.

3.3 Order Cancellation BY US

We may cancel orders that:

  • Appear to be bulk or wholesale orders not approved by us.

  • Are placed using fake details.

  • Show high fraud risk scores in our payment system.

  • Are unavailable due to stock issues.

  • Contain pricing errors.

3.4 Risk Transfer

Once your order is handed over to the courier partner, the risk of loss or damage transfers to the customer/courier. Any claims regarding courier damage must strictly follow the protocols outlined in our Refund Policy.

4. HEALTH & WELLNESS DISCLAIMER

4.1 Not Medical Advice

You agree to provide accurate account details and shipping information. We are not responsible for delivery delays or losses caused by incorrect addresses or contact numbers provided by you.

5.2 Cancellation Window

Orders cannot be cancelled after the 2-hour cancellation window has passed, as per our Refund Policy.

6. USER SUBMISSIONS (REVIEWS, PHOTOS, VIDEOS)

6.1 Right to Use

Any photos, testimonials, unboxing videos, reviews, or suggestions you send us may be used by us for:

  • Marketing & Advertising.

  • Social media content.

  • Customer education.

  • Product development.

  • Note: You agree to grant this usage right without compensation.

6.2 Moderation Rights

We may remove or reject any user-generated content that:

  • Contains offensive or false statements.

  • Violates privacy or laws.

  • Is marketing/advertising from third parties.

7. ERRORS & OMISSIONS

We may correct errors relating to product descriptions, stock availability, taxes, shipping timelines, or pricing at any time, even after the order is placed.

8. LIMITATION OF LIABILITY

Our total liability to you will never exceed the amount paid by you for the product.

  • Delivery delays caused by the courier.

  • Payment gateways (Banking).

  • Hosting platforms (e.g., Shopify).

  • External service providers.

9. INDEMNIFICATION

You agree to indemnify and hold Fresh Roots Naturals harmless from any losses, claims, or demands (including legal fees) arising out of:

  • Your breach of these Terms.

  • Your violation of any law.

  • Your misuse of the product.

  • Fraudulent chargebacks or fake claims filed by you.

External links (e.g., Instagram, WhatsApp, YouTube) may redirect you to third-party websites. We are not responsible for their content, privacy policies, or security practices.

11. SEVERABILITY

If any part of this agreement is found unlawful or unenforceable, the remaining portions shall continue to be valid and enforceable to the fullest extent permitted by law.

12. NO WAIVER

If we fail to enforce any provision of these Terms at any given time, it does not constitute a waiver of our rights to enforce them later.

13. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of India.

All disputes shall be subject to the exclusive jurisdiction of the courts in Kottayam/Ernakulam, Kerala, regardless of your location or any prior communication.

14. CHANGES TO TERMS

We may update these Terms at any time. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
